Terms of Service

1. Definitions

"Clinic" means the medical establishment that registers for the Services. "User" means an Admin, Doctor, or Staff member authorised by the Clinic. "Patient Data" means information about the Clinic's patients entered into the platform. "Services" / "Platform" means the TrackMyDoctor OPD management application.

2. Service Description

TrackMyDoctor provides outpatient queue management, patient registration, prescription writing, fee collection, and a display screen. TrackMyDoctor does not provide medical advice, clinical decision support, or legal compliance for the Clinic's own medical records.

3. Account and Access

The Clinic's Admin is responsible for all activity under the clinic account and must not share login credentials outside the organisation. The Clinic ID is assigned by TrackMyDoctor and is not transferable.

4. Acceptable Use

Clinics must not enter false or misleading patient data, attempt to access another clinic's data, reverse-engineer, or resell the Platform, or use it for any purpose other than managing their own OPD operations.

5. Data Ownership

All Patient Data entered into the Platform belongs to the Clinic. TrackMyDoctor acts as a data processor on behalf of the Clinic and does not claim ownership of any patient records. Patient Data is not shared with third parties except as required by law or as necessary to provide the Services.

6. Pilot, Subscription and Payment

Free pilot: During the launch pilot, each newly registered Clinic receives a free trial period of at least 45 days from its approval date. TrackMyDoctor may, at its discretion, extend a Clinic's free trial period beyond 45 days.

Conversion to paid: At the end of a Clinic's free trial period (as extended, if applicable), continued use of the Platform requires a paid subscription on the plan the Clinic selected (priced by the number of doctors and staff). Plans are billed monthly or annually. Applicable taxes (e.g. GST, where registered) are charged in addition.

Non-payment: On expiry, access is suspended and data is retained per Section 7.

7. Data Retention and Deletion

On subscription expiry: days 0–7 — data download window; days 8–127 — data retained and the Clinic may renew and resume with full history; day 128 onward — data is permanently deleted with no recovery.

8. Intellectual Property

TrackMyDoctor owns the Platform software, brand, and design. Clinics own their data and grant TrackMyDoctor a non-exclusive licence to process it to provide the Services.

9. Service Availability

TrackMyDoctor will make reasonable efforts to maintain availability. Scheduled maintenance will be communicated in advance where practicable.

10. Warranties and Disclaimers

The Platform is provided "as is". TrackMyDoctor is not a medical device and is not responsible for medical decisions made using the Platform, nor for the Clinic's compliance with any medical regulations.

11. Limitation of Liability

To the extent permitted by law, TrackMyDoctor's total liability is capped at the subscription fees paid by the Clinic in the preceding three months, and TrackMyDoctor is not liable for indirect or consequential damages.

12. Term and Termination

The Clinic may cancel at any time; the subscription runs to the end of the paid period. TrackMyDoctor may terminate for non-payment or misuse. A data export is available for 7 days after termination.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India, subject to the exclusive jurisdiction of the courts of Nagpur, India.

14. Changes to These Terms

TrackMyDoctor may update these Terms with notice by email and in-app. Continued use after the effective date of changes constitutes acceptance.
